____________________________________ LEGAL NOTICE ____________________________________ NOTICE OF APPLICATION TO AMEND EXISTING PERMIT TO USE GROUNDWATER PERMIT NUMBER 1986-595 Notice is hereby given that Wingard Water Corporation c/o Kaylee Davis-Maddy, Doerner, Saunders, Daniel & Anderson, LLP, 105 N. Hudson Ave., Suite 500, Oklahoma City, OK 73102, under the authority given in Oklahoma State Law, Title 82 §1020.7, has filed an application with the Oklahoma Water Resources Board, pursuant to Board rules, to amend groundwater permit #1986-595 to withdraw and use an additional 359 acre-feet of groundwater for a total of 447 acre-feet of groundwater per calendar year for the following uses: municipal (425 a.f.) and irrigation (22 a.f.). An additional 1,795 acres have been dedicated to this application and are located as follows: 160 acs. in the NW of Section 23, T2N, R4EIM; 575 acres in Section 10, 40 acs. in the S2 S2 SE of Section 17, 440 acs. in Section 20, 160 acs. in the SW, 80 acs. in the S2 NW, 20 acs. in the S2 NW NW, 80 acs. in the W2 NE and 40 acs. in the W2 W2 SE of Section 21, 200 acs. in the E2 of Section 22, T2N, R5EIM; all in Pontotoc County. This will bring the total lands dedicated to the permit to 2,235 acres. The lands proposed to be added to this water right are currently dedicated to other active permits. The application further requests adding eleven (11) wells currently authorized by other active permits located as follows: one in the SW NE NW of Section 23, T2N, R4EIM; two in the SE SE SE and one each in the SW SE SE, SE SW SE, SE NE SW and SE SE NE of Section 10, one each in the NW SE NW and SW SE SW of Section 21, and one each in the SW NE SE and SE NW NE of Section 22, T2N, R4EIM; all in Pontotoc County. This will bring the total number of wells to fourteen (14). It this amendment is approved, the following water rights will be cancelled: 1986-0568B, 1986-0571A, 1986-0567, 1986-0569A, 1986-571B and 2015-567. All other aspects of the permit remain the same. Board rules require that the wells be located a distance of at least 1,320 feet from existing wells or proposed well locations on lands of another unless a well location exception is granted. One such well location exception provides that the exception may be granted if no objection is received from any landowner having a well located within 1,320 feet of the well requested to be authorized. Use of groundwater is governed by Sections 1020.1 and following of Title 82 of the Oklahoma Statutes and rules of the Board, Oklahoma Administrative Code (OAC), Title 785, Chapter 30. Protests to the application must be in writing and received by the Board at the address listed below and by the applicant at the address listed above no later than July 18, 2016, and contain the following: (1) name, address, and telephone number of the interested person; (2) the particular application number to which the protest relates; (3) specific information to show how approval of the application proposed may directly and adversely affect legally protected interests of the person filing the protest; and (4) a statement of the relief sought by the interested person. A person who sends a letter containing only a general objection or comment will not be deemed to be a party, but the letter will be made part of the permanent record. A hearing on this application will be scheduled and the applicant and protestant(s) shall be advised of the hearing date upon receipt of a proper protest. Protesting parties or their representatives must appear at the hearing and present the protest in order that it may be considered. Hearings are governed by Section 309 of Title 75 and Section 1020.8 of the Title 82 of the Oklahoma Statutes, and the rules of the Board, OAC Title 785, Chapters 4 and 30.
