Case No. CJ-2016-59 NOTICE OF SHERIFFS SALE NOTICE is given that in pursuance of an Execution and Order of Sale issued out of the District Court of Pontotoc County, Oklahoma on the 17th day of October, 2016, in an action wherein UNITED STATES OF AMERICA was Plaintiff, and ROY D. SMITH, JR., a single person, et al., were Defendants, directed to me, the undersigned Sheriff of Pontotoc County, Oklahoma, commanding me to levy upon and sell with appraisement, the following described property situated in the County of Pontotoc, State of Oklahoma, to-wit: A part of the Southwest 10 acres of Lot 3 in Section 4, Township 4 North, Range 6 East, Pontotoc County, Oklahoma, more particularly described as follows: Beginning 445 feet South and 130 feet West of the Northeast corner of the Southwest 10 acres of said Lot 3 in Section 4; Thence South 145 feet; Thence West 225 feet; Thence North 145 feet; Thence East 225 feet to the point of beginning. APPRAISED VALUE: $118,000.00, to satisfy a judgment and decree of foreclosure in favor of said Plaintiff and against said Defendant, ROY D. SMITH, JR., obtained and made in said Court on the 19th day of September, 2016. Plaintiffs first lien judgment being in the principal sum of $97,285.32, plus accrued interest in the amount of $5,949.09, as of December 23, 2015, plus interest accruing thereafter at the rate of $15.99 per diem from December 23, 2015, until paid in full; Late Charges of $85.56; Fees (Receivable/Post) in the amount of $632.40; Escrow (current/Retain) in the amount of $803.00, and Max Subsidy Recapture in the amount of $16,140.09, for a total of $120,895.45, as of December 21, 2015, plus interest accruing thereafter in the amount of $15.99 per diem, until paid in full; court costs; abstracting and/or title search fees; a reasonable attorneys fee of $1,100.00; and for all subsequent advances by Plaintiff, if any, for taxes, insurance premiums, or expenses necessary for the preservation of the subject property, and for further costs of this action; I will on the 14th day of December, 2016, at 10 oclock a.m., of said day, at the front door of the Pontotoc County Courthouse in the City of Ada, Oklahoma, offer for sale and sell to the highest and best bidder for cash, the said property above described, or so much thereof as will satisfy said judgment, with interest, attorneys fees and costs.
