___________________________________ LEGAL NOTICE ___________________________________ Notice of Explanation of Project In a Floodplain                                      The County of Pontotoc has determined there is not a practical alternative to locating the proposed Community Development Block Grant project described below in a flood-prone area.    The Federal Funding (CDBG funds from Oklahoma Department of Commerce) is for Road Project.  The project serves the citizens of Pontotoc County.   The proposed project includes resurfacing with asphalt patch then double layer of oil, chip and seal, striping of CR3640 off Hwy 3 beginning at CR1640 South 3 miles to CR1670.  The project will not change the location of the existing road. A portion of the project, road is in the 100 year floodplain.      The project site is located on County Road 3640, Pontotoc County. Site maps are included.  Approximately 7.62 acres are involved in this project   The project as proposed will not have an adverse effect on the floodplains and the activities regarding construction will be completed in a manner that would not adversely affect flooding.  There will be no increase in flood hazard.    The improvements must be located in a flood-prone area because there is no practicable alternative to the proposed project. The proposed action will not affect natural or beneficial floodplain values as improvements will be to an existing county road which is already located in the floodplain.  Failure to provide these improvements would result in a negative impact to the citizens of Pontotoc County.  It is the County's judgment that the benefits of the proposed activity out-weigh any negative impact and the determination to expend Federal Funds in the floodplain is justified.   By the publishing of this notice, the County of Pontotoc is inviting any final comments prior to undertaking the proposed action.   All comments should be addressed to Gary Starns, Chairman Pontotoc County, PO Box 1425, Ada, OK 74820-1425, on or before November 28, 2016.           Gary Starns, Chairman

____________________________________ LEGAL NOTICE ____________________________________ DEQ NOTICE OF TIER II DRAFT PERMIT A Tier II application for an air quality operating permit renewal has been filed with the Oklahoma Department of Environmental Quality (DEQ) by applicant, Self Suspended Proppants LLC (SSP), P.O. Box 190, Roff, Oklahoma, 74865. The applicant requests approval to renew the Title V operating permit at the SSP facility located off SH-1 in Roff, Oklahoma, legally described as Township 2 North, Range 4 East, Section 26, Pontotoc County. The applicant operates a sand coating facility. In response to the application, DEQ has prepared a draft permit renewal (Permit Number 2016-0912-TVR3), which may be reviewed at the Ada Public Library, 124 S. Rennie Street, Ada, Oklahoma, 74820, or at the Air Quality Division’s main office (see address below). The draft permit is also available for review in the Air Quality Section of DEQ’s Web Page: http://www.deq.state.ok.us/. This draft permit would authorize the facility to emit the following regulated pollutants: PM10 (3.58 tons per year (TPY)), SO2 (0.07 TPY), NOx (10.65 TPY), VOC (53.18 TPY) and CO (8.95 TPY). The public comment period ends 30 days after the date of publication of this notice. Any person may submit written comments concerning the draft permit to the Air Quality Division contact listed below. A public meeting on the draft permit may also be requested in writing at the same address. Note that all public meetings are to be arranged and conducted by DEQ/CSD staff. In addition to the public comment opportunity offered under this notice, this draft permit is subject to U.S. Environmental Protection Agency (EPA) review, EPA objection, and petition to EPA, as provided by 40 CFR § 70.8. If the Administrator (EPA) does not object to the proposed permit, the public has 60 days following the Administrator’s 45 day review period to petition the Administrator to make such an objection as provided in 40 CFR 70.8(d) and in OAC 252:100-8-8(j).
